(ទីក្រុងទ្បំបុក ប្រទេសឥណ្ឌូនេស៊ី) នាថ្ងៃទី៧-១០ ខែវិច្ឆិកា ឆ្នាំ២០២៣ ឯកឧត្តម សួន វិជ្ជា ទីប្រឹក្សាក្រសួងពាណិជ្ជកម្ម ប្រធានលេខាធិការដ្ឋានគណៈកម្មាធិការជាតិគ្រប់គ្រងកម្មសិទ្ធិបញ្ញា និងជាប្រធាននាយកដ្ឋានកម្មសិទ្ធិបញ្ញា បានដឹកនាំប្រតិភូអន្តរក្រសួងទទួលបន្ទុកកម្មសិទ្ធិបញ្ញា ចូលរួមកិច្ចប្រជុំក្រុមការងារសហប្រតិបត្តិការកម្មសិទ្ធិបញ្ញាអាស៊ាន លើកទី៧១ និងកិច្ចប្រជុំជាមួយដៃគូ នៅទីក្រុងទ្បំបុក ប្រទេសឥណ្ឌូនេស៊ី។កិច្ចប្រជុំបានលើកឡើងនូវចំណុចសំខាន់ៗ នៃសេចក្តីសម្រេចចិត្តក្នុងកិច្ចប្រជុំរដ្ឋមន្ត្រីសេដ្ឋកិច្ចអាស៊ាន និងឧត្តមមន្ត្រីសេដ្ឋកិច្ច(SEOM) ពាក់ព័ន្ធនឹងបញ្ហាកម្មសិទ្ធិបញ្ញា ដែលរួមមាន៖ ១. ការបញ្ចប់ការសិក្សាស្តីពី លក្ខខណ្ឌទម្រង់បែបបទដែលមានសុខុមនីយកម្មសម្រាប់គំនូរឧស្សាហកម្ម ២. ការសិក្សាអំពីការវិភាគគម្លាតពាណិជ្ជកម្មអេឡិចត្រូនិក (E-Commerce) ច្បាប់កម្មសិទ្ធិបញ្ញា និងជំរុញឱ្យក្រុមការងារ AWGIPC ចុះអនុស្សារណៈយោគយល់គ្នា (MoU) រវាង ថ្នាលពាណិជ្ជកម្មអេឡិចត្រូនិក (E-Commerce Platform) តំបន់ ជាមួយនឹងសមាជិកអាស៊ាននីមួយៗ ៣. ការសិក្សាស្តីពីសិទ្ធិអ្នកនិពន្ធ និងអង្គភាពគ្រប់គ្រងសិទ្ធិរួម ៤. ការចុះ MoU រវាងអាស៊ាន និងអង្គការកម្មសិទ្ធិបញ្ញាពិភពលោក (WIPO) ស្តីពីកិច្ចសហប្រតិបត្តិការ ដើម្បីបង្កើតកម្មសិទ្ធិបញ្ញា កិច្ចការពារ ការអនុវត្តន៍ និងការធ្វើជូបនីយកម្ម ។កិច្ចប្រជុំ ក្រុមការងារសហប្រតិបត្តិកម្មសិទ្ធិបញ្ញាអាស៊ាន លើកទី៧១ នេះមានសារៈសំខាន់ណាស់សម្រាប់តាមដាន និងការអនុវត្តផែនការសកម្មភាពកម្មសិទ្ធិបញ្ញាអាស៊ាន២០១៦-២០២៥ ដែលបច្ចុប្បន្នសម្រេចការអនុវត្តបានប្រមាណ ៧៨% ដែលក្នុងនោះកម្ពុជាត្រូវដឹកនាំផែនការសកម្មភាពចំនួន ២ គឺ៖ ១. បញ្ជរផ្តល់ព័ត៌មានកម្មសិទ្ធិបញ្ញា (IP Help Desk) ២. ធនធានពន្ធុ (Genetic Resources-GR) ចំណេះដឹងប្រពៃណី (Traditional Knowledge-TK) និងវិញ្ញត្តវប្បធម៌ (Traditional Cultural Expressions-TCE) និងចូលរួមអនុវត្តសកម្មភាពដទៃទៀតជាមួយបណ្តាប្រទេសអាស៊ាន។ កម្ពុជាបានទាញយកប្រយោជន៍ជាច្រើនពីផែនការសកម្មភាពកម្មសិទ្ធិបញ្ញានេះ ដោយបានសហការជាមួយដៃគូអភិវឌ្ឍន៍ ដើម្បីចូលរួមអនុវត្តគម្រោងនានារបស់លេខាធិការដ្ឋាននៃគណៈកម្មការជាតិគ្រប់គ្រងកម្មសិទ្ធិបញ្ញា (គ.ក.ប.) រួមមាន៖ ម៉ាក ប្រកាសនីយបត្រតក្កម្ម ម៉ាកសម្គាល់ភូមិសាស្ត្រទំនិញ គំនូរឧស្សាហកម្ម សិទ្ធិអ្នកនិពន្ធ បច្ចេកវិទ្យាតាមប្រព័ន្ធបញ្ញាសិប្បនិម្មិត បច្ចេកវិទ្យាតាមប្រព័ន្ធអេឡិចត្រូនិក ការអប់រំលើកកម្ពស់ចំណេះដឹង និងកិច្ចសហប្រតិបត្តិការផ្សេងៗ។ដោយទ្បែក កិច្ចប្រជុំក្រុមការងារសហប្រតិបត្តិកម្មសិទ្ធិបញ្ញាអាស៊ាន លើកទី៧១ ក៏មានកិច្ចប្រជុំពាក់ព័ន្ធជាមួយដៃគូអង្គភាពកម្មសិទ្ធិបញ្ញា ដូចជា៖ ១. កិច្ចប្រជុំជាមួយអង្គភាពកម្មសិទ្ធិបញ្ញាសាធារណរដ្ឋកូរ៉េ (KIPO) ២. កិច្ចប្រជុំជាមួយអង្គការកម្មសិទ្ធិបញ្ញាពិភពលោក (WIPO) ៣. កិច្ចប្រជុំជាមួយអង្គភាពប្រកាសនីយបត្រតក្កកម្មជប៉ុន(JPO) ៤. កិច្ចប្រជុំជាមួយអង្គភាពកម្មសិទិ្ធបញ្ញាអង់គ្លេស (UKIPO) ៥. កិច្ចប្រជុំជាមួយអង្គភាពប្រកាសនីយបត្រតក្កកម្ម និងពាណិជ្ជសញ្ញាសហរដ្ឋអាមេរិក (USPTO) ៦. កិច្ចប្រជុំជាមួយសមាគមពាណិជ្ជសញ្ញាអន្តរជាតិ (INTA) ៧. កិច្ចប្រជុំជាមួយអង្គភាពកម្មសិទិ្ធបញ្ញាសហភាពអឺរ៉ុប (EUIPO) ៨. កិច្ចប្រជុំជាមួយ ហុងកុង និង ៩. កិច្ចប្រជុំជាមួយអង្គភាពកម្មសិទ្ធិបញ្ញាចិន ។

(Lombok, Indonesia): On 7-10 November 2023, His Excellency SUON Vichea, Advisor to the Ministry of Commerce, Chairman of the Secretariat of the National Committee for Intellectual Property and Director of Department of Intellectual Property, led an inter-ministerial delegation in charge of intellectual property to attend the 71st ASEAN Intellectual Property Cooperation Working Group(AWGIPC) Meeting and Meeting with Partners in Lombok, Indonesia.

The meeting highlighted the key points of the decisions of the ASEAN Economic Ministers and Senior Economic Officials (SEOM) Meeting relating to intellectual property issues, including: 1. Completed study on harmonizing requirements for Industrial Design 2. Study on E-Commerce gap analysis, intellectual property law and urge the AWGIPC to sign a Memorandum of Understanding (MoU) between regional e-commerce platforms with each ASEAN member 3. Study on Copyright and Collective Management Organizations 4. Signing of MoU between ASEAN and World Intellectual Property Organization (WIPO) on cooperation to establish intellectual property, protection, implementation, and acquisition.

The 71st ASEAN Intellectual Property Cooperation Working Group Meeting is very important for monitoring and implementing the ASEAN Intellectual Property Action Plan 2016-2025, has now achieved about 78%, which Cambodia leads two action plans: 1. Intellectual Property Information Desk (IP Help Desk) 2. Genetic Resources (GR), Traditional Knowledge (TK) and Traditional Cultural Expressions (TCE) and participate in other activities with ASEAN countries. Cambodia has benefited greatly from this Intellectual Property Action Plan by collaborating with development partners to implement projects of the Secretariat of the National Committee for Intellectual Property(NCIP), including: Trademark, Patent, Geographical Indication, Industrial Design, Artificial Intelligence technology, electronic technology, Public awareness and other cooperation.

In addition to the 71st AWGIPC meeting, there are also related meetings with partners of the Intellectual Property Organization such as: 1. Republic of Korea Intellectual Property Organization (KIPO), 2. World Intellectual Property Organization (WIPO) 3. Japan Patent Office (JPO), 4. Intellectual Property Office of the United Kingdom (UKIPO) 5. United States Patent and Trademark Office (USPTO), 6. International Trademark Association (INTA), 7. European Union Intellectual Property Office (EUIPO), 8. Hong Kong and 9. China National Intellectual Property Administration.
